Ex-Amgen Worker Files Suit Over Health Plan Tobacco Use Penalty
A former Amgen Inc. employee has filed a proposed class action lawsuit, alleging that the biotechnology company unfairly charges an extra $150 per month for health-care coverage to employees who smoke. The lawsuit claims Amgen penalizes tobacco users without providing a legally compliant way for them to avoid the surcharge, offering only “vague promise” of cessation resources. The plaintiff, Sanjay Sharma, stated that the company’s benefit materials lack clear alternatives for workers to satisfy to remove the penalties.
