Tianan Seller's Welfare Lottery Development Violated Regulations, Fined 375,000
The Estate Agents Authority (EAA) successfully prosecuted Fook Choi Development for violations of the Residential Properties (First-hand Sales) Ordinance in Tuen Mun’s Siu Kwan Court, resulting in a fine of HKD 375,000.
Fook Choi Development faced 45 charges, including failing to provide the public with copies of the sales brochure printed or reviewed within the previous three months at least 7 days before the sale date (15 charges), failing to provide copies of the sales brochure printed or reviewed within the previous three months on the sales date at the sales office (15 charges), and failing to provide the text of the sales brochure printed or reviewed within the previous three months on its designated internet website on the sale date (15 charges). These violations correspond to Sections 25(1), 25(2), and 25(3) of the Ordinance, respectively.
Fook Choi Development admitted to the charges today at Kwun Tong Magistrates’ Court and was convicted, receiving a total fine of HKD 375,000.
A spokesperson for the EAA stated that the authority has been implementing a three-pronged approach to enforce the Ordinance, which includes enhanced inspections, patrols, and evidence collection for prosecutions; continuously improving industry compliance; and increasing public awareness of the Ordinance. The EAA will take strict action and conduct investigations if any suspected violations are found, aiming to enhance transparency and fairness in the sale of first-hand residential properties, protect buyers’ interests, and provide a fair competitive environment for sellers.
