Crypto Reporter: US judges seem to be more sympathetic towards Uniswap developers, "neutral infrastructure" may be a key criterion
Odaily Planet Daily reports that crypto journalist Eleanor Terrett posted on X platform that she reviewed the trial of Tornado Cash co-founder Roman Storm. During the case, Judge Failla used a self-driving car as an analogy in a lawsuit filed by user Nessa Risle against Uniswap, seemingly showing more sympathy for the developers behind Uniswap and being stricter toward Tornado Cash’s developers. According to materials shared by Eleanor Terrett, the judge’s view is that holding software developers responsible for strangers’ misuse of neutral infrastructure would be illogical—that is, considering Uniswap as “neutral infrastructure,” while Tornado Cash is seen as “participating in illegal financial activities” (continuing operations despite knowing it was used for money laundering). This statement indicates that future U.S. court decisions on the liability of decentralized finance (DeFi) infrastructure may consider whether developers merely provide neutral tools rather than actively participating in illegal activities.
